about competing with
J&B Fleet, Alliance, Ohio

ATTENTION: J & B Fleet Employees

To Whom It May Concern:

Recently, it was brought to my attention that employees of J&B Fleet were given false information directly by Bill (owner of J&B Fleet); consequently, false statements were made which were not only untrue and misleading, but has compromised my professional reputation. It was relayed to me that Bill told you, "that he ended his relationship with Rick Miller (owner of CFIS Group) because Rick had decided to go direct with suppliers and not pay Bill what he owed him." If this is what you were told, then it is a complete lie, and explains why Dave and Steve have lied in the past and continued to lie to customers.

A contract Agreement was entered into between Bill and Rick on 03/04/03. This Agreement was for Rick to start his own warehouse (owned by Rick not Bill) far enough away from Bill's warehouse in Alliance so that other sales reps would not compete with them. Start-up capital was paid in full by Rick Miller and guaranteed by Rick's reserve funds that Bill controlled.

The Agreement stated that Rick would not sell in 56 counties surrounding the Alliance area. The stipulation was that J&B Fleet would stay out of Columbus after disclosing all the accounts that they sold to in Columbus at the time of the contract.

All the accounts were not disclosed; therefore, Bill was not forthright. Additionally, Dave, Steve, and Mark were not told to stay out of Columbus they were only asked to. As a result, all three sales men encroached upon territory belonging to CFIS Group and in violation of terms of Agreement mutually agreed upon between both parties. The infringement was brought to Bill's immediate attention and if continued, was just cause for termination of Agreement.

When Rick found that Bill was not going to enforce this part of the agreement Rick came to Bill and personally handed him a check for the total amount owed after deducting the reserve account amount; furthermore, Rick ended the agreement paying Bill all that was owed to him, in full.

Rick Miller paid J&B Fleet for all invoices on all inventory with interest [Check #1637] $29,127.60 after deducting the $26,037.38 that J&B Fleet owed Rick Miller for over 20 years...In the six years that J&B Fleet purchased products with CFIS Group, J&B Fleet profited $93,038.05. Just how much more profit does J&B Fleet wish to make?

Bill entered into a legal battle with Rick in 2008. Bill lost his legal battle and lost his appeals. Verification of above is part of the Court's public records and available below.

While Rick believed matters had been reconciled due to legal rulings in Rick's favor, it is alarming that Dave and Steve still continue to lie to customers stating that Rick stole inventory from J&B Fleet. If they are such honest people then why do they continue to lie? Especially disturbing is Dave claiming himself to be honest, and, a Christian. Clearly, this is a prime example of one using one's faith when it is convenient and beneficial.

As J & B employees you all know how very hard I worked to grow J & B Fleet to the size it is today. I, personally:

  • pushed Bill to let me add salespeople;
  • opened accounts for each salesperson I hired; (Yes, even you Dave, unlike you I did not sell the accounts to salespeople when they were just starting out);
  • created and secured the web sites for J & B;
  • created the customer bin label system;
  • had a J & B logo created for the bin boxes;
  • went to the venders and negotiated better pricing (a job Bill should have been doing);
  • and, assisted each and every salesperson anytime they asked.

After all of that, and more, this is how I am treated by Bill (owner of J & B Fleet), with lies being told about me by Bill, Dave, and Steve. Behavior and practices by all three show their lack of capacity in competing with me honestly. Their demeanor shows lack of integrity and character.

In closing, I DO NOT, NOR DO I HAVE TO CHEAT ANYONE, as I do have a conscience and believe that what goes around, comes around. You don't cheat a company like Hendrickson by selling them a microwave and invoicing it as cases of aerosols to dishonestly sneak it into the plant, just one of the examples of the games you pull.

Seriously, how can customers possibly trust any of you Bill, Dave and Steve?

It is unfortunate that the J&B Fleet sales force has forced me to defend myself.

I apologize to all my customers that have been confused by the entertaining stories that certain J&B Fleet sales persons have decided to misdirect you with. I have no doubt this is to delay your switch to a price competitive company such as CFIS Group.

UPDATE June 2011: The courts have ruled that J&B Fleet may no longer waste the court's time in appealing this case any longer.

Lie being told...

This one is Salesman Dave's way to attempt to keep customers from switching long enough to win back their trust, (classic sales tool, it's been used for a long time) "Mr. Customer, You would be the only customer of mine that switched to CFIS Group." or this one: "Mr. Customer I have very large Customers who allow me to control their Inventory."

Dave, for you being such an Christian as you claim, then why do you continue with your lies, is your religion for Sunday only? Oh, thats right, you will pray for me, Dave pray for yourself - You are the one that needs it.
      The truth...

Many companies have switched and more are switching every week. Wake-Up Dave, customers are tired of you increasing your prices, supporting your Two Hundred and Twenty Thousand per year commissions that you brag about, and the One Hundred Thousand in commissions that you make a year from a certain fuel hauler.

Switching to CFIS Group would be a mistake, they have a reputation for being crooked, and have screwed over many customers.
     
The truth...

Many companies have switched and none have regretted it. The truth is; many companies no longer allow J&B Fleet to service them, such as L&_ Ref___, Per__ School Bus Garage, Ost__ San_ & Grav__, Wein___ Excvat___, Stock__ Trucking, Smi__ Nurs___ & Narr__ Wa_ Truck Repair just to name a few. Just ask them why they switched suppliers. CFIS Group is an honest company, invoicing with full description and quantity. We are a no game supplier where "American Made" does matter.

Lie being told...

"Rick Miller is competing with Mike Sidel, who purchased the sales route Rick Miller was servicing for over 30 years through J&B Fleet, Alliance, Ohio."
     
The truth...

Rick Miller is NOT competing with any account in question, a list of the accounts in question is posted below. Rick Miller opened a warehouse in Columbus, Ohio in 2003 with an agreement that J&B would stay out of the Columbus area. J&B Fleet broke the agreement by selling to and shipping to customers in Columbus, Ohio.

"CFIS Group is just low-balling prices to get your business and will then play price games."
     
The truth...

Place your order with us and we will gladly prove them wrong. Unlike J&B Fleet, Alliance, Ohio, CFIS Group has one price for all customers. J&B Fleet has many prices for their customers. It is the sales person that has the final call on raising or lowering your price at any time.

Lie being told...

"Rick Miller stole his inventory from J&B Fleet and never paid for it, that is why his prices are so low. When that inventory is gone and he has to buy more, your prices will go up."
     
The truth...

It was over 5 years ago that we have ended our association with J&B Fleet because of their breach of contract. Our inventory turns over 6 to 7 times a year and our prices have still remained low.

And #1 on our list of lies is: "You don't want to switch your business to CFIS Group, I know they are much lower in price, I know they sell quality products, I know they have over 30 years of experience, I know they are a local company giving the best possible price at all times... But they are in a nasty lawsuit with J&B Fleet Alliance that you really don't want to get in the middle of."
     
The truth...

It was J&B Fleet who filed a lawsuit against CFIS Group in 2008, since then, J&B Fleet has lost the lawsuit.

This should have never went to court...WHAT ELSE COULD WE EXPECT FROM THEM, THEY DO NOT WANT ANY COMPETITION.

"Your pricing was a mistake in the computer. I can set your account up with CONTRACT PRICING."
     
The truth...

CONTRACT PRICING is not what it sounds like. Contract Pricing is when the salesman makes a list of discounts they want to sell each item for to a particular customer. This is entered in the computer at the warehouse, so, if you call in for a price, the warehouse knows what to tell you the price is (sound familiar). The salesman can override and raise or lower the price of any item at any time.

The accounts listed in the agreement are listed below:

Note: If any of the accounts below have canceled Mike Sidel from servicing their account and have switched to another supplier, and if that supplier does not work out for you then you may contact CFIS Group for pricing...... Keep in mind that we will not interfere with your relationship with Mike Sidel.

Contract Quote:    Seller and Buyer agree that the original terms of their Purchase Agreement shall continue in full force and effect to the extent necessary to carry out the original understanding of the parties and further acknowledge that Seller shall not contact any of the accounts covered by the agreement or otherwise interfere with Buyer's continuing and future relationship with said accounts.
